It seems like something that would happen in a TV sitcom. Josh Gordon was suspended for week 16 last season because he didn’t show up for the walkthrough the day before the game. His reasoning for appealing the suspension is that he says the Browns didn’t notify him in writing that he was late half a dozen times so it wasn’t fair to suspend him for an entire game for skipping practice the day before.
Seriously.
This is actually a huge deal for Gordon. If the suspension is upheld, it means he did not play in enough games to accrue a season of his contract, which means he won’t be a free agent until the 2017 season. If his appeal is successful then he hits free agency in 2016. That’s assuming he comes back from the current year-long suspension that he’ll be serving in 2015 for breaking his reinstatement agreement that he would stop drinking alcohol. He’s sure to appeal that suspension too based on his argument that he thought he was allowed to drink in the offseason.
I’m no lawyer, but I’d say that appeal is doomed for failure as well.

Really depends….the thing is, unions are tough to work with anyway you look at it. The thing is, if it states in the union contract that for what they are suspending him for must be documented and the clowns did no such thing – which wouldn’t surprise me, then its already a done deal. Any judge will not rule against the rules for hearsay.
We sit here and say its ridiculous. But here is the thing brah – what do we know besides what some reporters are writing – has any of this been confirmed – or better yet documented? If it is not documented, then I have to favor for gordon too in which he should leave cleveland any way you look at it.
Hue Jackson is a loser.
February 18, 2015 at 8:21 am #739IceKeymasterThe part that has been confirmed is the fact that the thrust of his appeal is that he wasn’t notified that he was in trouble for being late to meetings. That’s all we know for sure, because that’s what is in his appeal.
The hearsay right now is that the team DID notify him in writing half a dozen times that he was late and further occurrences would lead to disciplinary action.
I’m glad I’ve never had to deal with unions. What a farce. I can just imagine if someone working for me did a no-call-no-show and then argued their firing.
“Mr. Ice, you can’t fire me. It’s my first offence.”
“No, it’s your 7th offense.”
“What?!? You never notified me that I was late before.”
“Yes I did. I yelled at you each time and the last time it happened I told you one more time and you’d be fired. I was very clear about that.”
“Well yeah you TOLD me that, and you did yell at me in front of the whole team in the meetings I was late too, but did you write it down?”
“Yes.”
“Oh. Fu__.”February 18, 2015 at 8:25 am #740IceKeymasterAlso I don’t think there’s any way Gordon plays another down for the Browns after this. The only reason we care about winning this appeal is because winning it will greatly increase his trade value. The Browns are done with Gordon.
February 18, 2015 at 10:54 pm #772IceKeymasterMary Kay Cabot is quoting Mike Pettine as firmly stating at his press conference that Gordon was indeed fined for being late 5 or 6 times. So either he or Josh Gordon is outright lying.
Call me crazy but I’ll trust the guy who isn’t currently serving his umpteenth suspension.
